Can I forgive a loan to my child?
If you want to make a large financial gift and not use up any of your lifetime gift and estate tax exemption, you can make a loan (with interest) and then forgive the interest, the principal payments, or both, each year under the annual gift tax exclusion.
Before you forgive an intrafamily loan, consider any potential income tax issues for you and the borrower. In most cases, forgiving a loan to a loved one is considered a gift, which generally has no income tax consequences for either party.
Conversely, if the lender wants to forgive the loan, the unpaid amount will be treated as a gift for tax purposes. Then, the borrower may owe taxes on the remaining unpaid interest.
Parent borrowers may be eligible for Public Service Loan Forgiveness (PSLF) after making 120 qualifying payments (ten years). Parent PLUS loans are eligible if they are in the Direct Loan program or included in a Federal Direct Consolidation Loan. The borrower must work full-time in a qualifying public service job.
In most cases, you won't have to pay taxes for a “loan” the IRS deemed a gift. Even if you exceed the $17,000 annual gift exclusion we mentioned before, you only owe gift tax when your lifetime gifts to all individuals exceed the lifetime gift tax exclusion.
For 2021, you can forgive up to $15,000 per borrower ($30,000 if your spouse joins in the gift) without paying gift taxes or using any of your lifetime exemption. (These amounts are the same as in 2020.) But you will still have interest income in the year of forgiveness. Forgive (don't forget).
If you want to know how to transfer a parent PLUS loan to a student, the answer is simple: Your student can take on the loan by refinancing it in their own name. As long as the student can qualify to refinance on their own, they can assume full responsibility for the debt.

Can I forgive a loan to a family member?
Intra-family loans, including the interest or the loan in full or in part, can be forgiven. When a loan is forgiven, it does not mean the borrower must consider it as discharge of indebtedness income.
To be eligible, your annual income must have fallen below $125,000 (for individuals) or $250,000 (for married couples or heads of households). If you received a Pell Grant in college and meet the income threshold, you will be eligible for up to $20,000 in debt relief.
There is no forgiveness available to Parent PLUS Loan borrowers looking to retire. Remember that Parent PLUS Loan forgiveness is only possible through the Income-Contingent Repayment Plan or PSLF after first consolidating your Parent PLUS Loan into a federal Direct Consolidation Loan.
Most debt isn't inherited by someone else — instead, it passes to the estate. During probate, the executor of the estate typically pays off debts using the estate's assets first, and then they distribute leftover funds according to the deceased's will. However, some states may require that survivors be paid first.
Document the Agreement
Both of you should sign the document. It doesn't have to be overly complex, but it should set the terms for the lender and borrower. In addition, it should demonstrate to any outside parties, such as debtors or the IRS, that the loan is legitimate, especially in the event of litigation.
Tax implications: If the family loan is interest-free and over a certain amount ($17,000 in 2023 or $18,000 in 2024), the lender may need to file a gift tax return. If the loan includes interest, the lender must follow IRS interest rate guidelines and potentially report it as income.
On the borrower's side, there are typically no tax implications. The borrower doesn't typically need to report the loan and won't pay any income tax on it. In some cases, the borrower may get a tax perk from borrowing money from family.
Tax implications of loans to family members
While family members can charge interest rates below current market rates, the applicable federal rate is the minimum interest the lender can charge for loans more than $10,000. If you charge less than this rate, you'll have to pay taxes on the unearned interest.
What's the federal gift tax exclusion for 2023? In 2023, the annual gift tax limit was $17,000. For married couples, the combined 2023 limit was $34,000.
That includes “borrowing” a child's identity to obtain credit or something else in their name. This is actually a type of fraud, although many parents may not think of it this way. It's largely a crime of opportunity.

Bottom Line. Unless you have gifted more than $12.92 million over your lifetime, you can almost certainly give a $50,000 down payment to your daughter or other family member and not owe gift taxes in 2023. Just be careful to do the paperwork right, otherwise, it could complicate the loan.
Nothing in the tax law prevents you from making loans to family members (or unrelated people for that matter). However, unless you charge what the IRS considers an “adequate” interest rate, the so-called below-market loan rules come into play.
Everyone legally has the option to borrow from family or friends if both parties are willing. If you handle loaning money correctly, everyone can end up winning. These loans are often referred to as private home loans, a personal loan or an intra-family loan. They are not as uncommon as you might imagine.
